Terms of Service

1. Who we are and acceptance

GradeForge (the "app", "we", "us") is provided by GradeForge by Rhys Richardson and James Jones, based in Wales, United Kingdom. By buying, downloading, installing or using GradeForge, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the app.

2. Your licence

On purchase you receive a non-exclusive, non-transferable licence to install and use GradeForge for your own teaching. An individual licence is for one teacher; school "site licences" cover the staff of the named organisation. You may not resell, sub-licence, rent, share your installer or licence with others, or redistribute the software. Version 1 updates are included; a future major version may be a separate purchase.

3. Google and other third-party services

Connecting a Google account is optional and enables features such as Google Classroom import, posting work, pushing grades, reading files you select, and syncing through your own Google Drive. When you connect Google, you also agree to Google's terms. GradeForge acts only on your behalf, through your own account; we do not operate a server that receives your Google data. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements (see the Privacy Policy). Any optional AI provider you configure is your own account, subject to that provider's terms.

4. Acceptable use

You are responsible for how you use GradeForge and for the pupil and personal data you enter, in line with your own and your school's data-protection and safeguarding duties. You agree not to misuse the app, attempt to circumvent its licensing, reverse-engineer it except as permitted by law, or use it unlawfully.

5. Payment and refunds

The seller is GradeForge by Rhys Richardson and James Jones. Card payments are processed securely on our behalf by Stripe; we never see or store your card details. The price is £30 (GBP), a one-off charge shown at checkout. As a digital product, refunds are handled reasonably and in line with your statutory rights; contact us if something is wrong and we will put it right.

6. Intellectual property

GradeForge, its name, logo and software are owned by us and protected by law. These terms grant you a licence to use the app, not ownership of it. Content you create with GradeForge (worksheets, reports, your markbook) is yours.

7. Disclaimers and liability

GradeForge is provided "as is". While we work hard to make it reliable, we do not warrant that it will be error-free or uninterrupted. It is a teacher's assistant: you remain responsible for professional decisions, marks, reports and any data you submit to Google or elsewhere. To the fullest extent permitted by law, our liability is limited to the amount you paid for the licence, and we are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law.

8. Data protection

How we handle data is set out in our Privacy Policy. GradeForge is offline-first: pupil data is stored encrypted on your device, and you (or your school) are the data controller.

9. Changes and termination

We may update these terms as the app evolves and will post the new date above. We may suspend a licence that is being misused (for example, shared or resold). You may stop using the app at any time.

10. Governing law

These terms are governed by the law of England and Wales, and disputes are subject to its courts.
